1. Acceptance of Terms

If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least thirteen (13) years of age to use our Service. By using the Service, you represent and warrant that you are at least 13 years old. If you are under the age of eighteen (18) or the age of legal majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration & Responsibilities

• Accurate Information: To use certain features of our Service, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
• Account Security: You are responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized such activities or actions. You agree to notify us immediately of any unauthorized use of your account.
• Responsibility for Activities: You are solely responsible for all activities that occur under your account and for your conduct while using the Service.

4. Nature of the Service ‐ Recommendation Engine

• Our Service is designed as a recommendation engine to assist users in exploring potential university options based on the information they provide.
• No Guarantee of Acceptance: We explicitly state that we do not, and cannot, guarantee university application acceptance or admission to any educational institution. Admission decisions are made solely at the discretion of the respective universities and their admissions committees.
• Informational Purposes Only: The recommendations and information provided by our Service are for informational and guidance purposes only. They should not be considered as definitive advice or a guarantee of any particular outcome.

5. Data & Privacy

Data Collection and Use (Web Service):

• Results Storage: To enhance your user experience, we save your input and results so you do not have to re-enter them each time you use the Service. You have the option to clear this data, at which point we will endeavor to remove it from our active systems promptly, subject to our backup and archival policies.
• Account Management: We collect basic personal information (such as name, email address) for account creation, management, and communication purposes related to your account.
• Promotional Communications: We may offer you the option to subscribe to promotional messages or newsletters. This is strictly opt-in. You can subscribe or unsubscribe from these communications at any time through your account settings or by following the unsubscribe link in the emails.

Data Handling (Mobile Application, if applicable):

• Local Storage: If you use our mobile application, user data you input and the results generated may be stored locally on your device.
• On-Device Data: All user-provided data and generated results specific to the app's functionality are intended to be kept on your device unless you explicitly choose to back it up or sync it with a cloud service.

6. User Conduct

You agree not to use the Service to:

7. Intellectual Property

All rights, title, and interest in and to the Service (excluding content provided by users) are and will remain the exclusive property of Pioneerd and its licensors. The Service is protected by copyright, trademark, and other laws of Ghana and foreign countries. Nothing in the Terms gives you a right to use the Pioneerd name or any of the Pioneerd trademarks, logos, domain names, and other distinctive brand features.

8. Disclaimers

• THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION.
• WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
• WE ARE NOT RESPONSIBLE FOR ANY DECISIONS MADE BY UNIVERSITIES REGARDING STUDENT ADMISSIONS OR REJECTIONS, NOR FOR ANY ACTIONS TAKEN BY YOU BASED ON THE RECOMMENDATIONS OR INFORMATION PROVIDED BY THE SERVICE.
• WE ARE NOT RESPONSIBLE FOR ANY CONSEQUENCES, EMOTIONAL, FINANCIAL, OR OTHERWISE, RESULTING FROM UNIVERSITY ADMISSION OR REJECTION DECISIONS, OR FROM YOUR RELIANCE ON THE SERVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PIONEERED, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US TO USE THE Service IN THE 12 MONTHS PRIOR TO THE CLAIM

10. Indemnification

You agree to defend, indemnify, and hold harmless Pioneerd and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your use and access of the Service; (b) a breach of these Terms; or (c) Content posted on the Service.

11. Termination

• We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
• If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
• All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
